Merchant Personal Data Protection Notice

1. Identity of the Data Controller

Pursuant to the Turkish Personal Data Protection Law No. 6698 ("KVKK"); Track to Fresh Bilişim Teknoloji Gıda ve Sanayi Ticaret Anonim Şirketi ("Company"), located at Esentepe Mah. Ecza Sk. Pol Center C Blok No: 4 İç Kapı No: 1 Şişli/İstanbul with tax identification number 8591142788, as data controller, processes personal data of Merchant representatives and sole proprietorship owners within the purposes and limits explained below.

2. Your Personal Data Being Processed

The following categories of your personal data are processed during applications made through our website, electronic approval processes, and throughout our commercial relationship:

  • •Identity Data: Name, surname, Turkish ID Number (only for sole proprietorships when required)
  • •Contact Data: Email address, mobile phone number, business address
  • •Financial Data: Tax Identification Number (VKN), tax office, invoice information, IBAN, bank account details and accrual/reconciliation amounts
  • •Professional and Commercial Data: Business name, representation authority information, sector and kitchen/concept type
  • •Transaction Security Data: Website login/logout logs, IP address, electronic contract approval timestamps (time-stamp) and device information

3. Purposes of Processing Your Personal Data

Your collected personal data is processed for the following purposes within the scope of services provided by our company:

  • •Execution of Contract Processes: Establishment of the Kitchenest Merchant Agreement electronically, proof of digital approval and fulfillment of contract terms
  • •Platform Integrations: Opening your store/restaurant under our brands on Online Order Platforms (Trendyol Yemek, GetirYemek, Yemeksepeti, Migros Yemek, etc.) within the scope of your cooperation with our Company and managing order processes
  • •Financial and Accounting Transactions: Calculation of your accruals through PaketHesap or similar financial reconciliation infrastructures, commission/service fee offsets, invoicing operations and transfer of payments to your bank accounts
  • •Operational Processes: Providing menu integration, visual updates, campaign notifications and operational support services (call center, etc.) for your business
  • •Legal Processes: Fulfillment of our Company's legal obligations, use of system records and approval logs as evidence in possible disputes

4. Method and Legal Grounds for Personal Data Collection

Your personal data is collected through fully automatic or partially automatic methods by filling out application forms on our Company's website, digitally signing contracts with the "I have read, I approve" button, email communications and panel logins.

This data is processed based on the following legal grounds set forth in paragraph 2 of Article 5 of KVKK:

c) Being necessary for the processing of personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract (commercial activities within the scope of the Merchant Agreement),

ç) Being mandatory for the data controller to fulfill its legal obligation (Ministry of Finance notifications, log keeping obligation under electronic commerce legislation),

f) Being mandatory for the processing of data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

5. Parties to Whom Your Personal Data is Transferred and Transfer Purposes

Your personal data is transferred to the following recipient groups domestically in accordance with the conditions specified in Article 8 of KVKK in order to fulfill the requirements of our business model:

  • •To Online Order Platforms: For the purpose of opening your sales point (store/restaurant), menu integration and order routing (Trendyol Yemek, GetirYemek, Yemeksepeti, Migros Yemek, etc.)
  • •To Finance and Payment Institutions: To banks, payment infrastructure providers and e-transformation (integrator) companies for the purpose of paying your accruals resulting from reconciliation, collection transactions and e-invoice/e-archive arrangements
  • •To Authorized Public Institutions and Organizations: To the Ministry of Finance, SGK, judicial authorities and other authorized administrative bodies for the purpose of fulfilling our legal obligations
  • •To Our Consultants: To Company lawyers and financial advisors for the purpose of exercising our right of defense in possible legal processes and conducting financial audits

6. Your Rights Under KVKK

Pursuant to Article 11 of KVKK, you can exercise the following rights regarding your personal data by applying to our Company as data controller:

  • •Learning whether personal data is being processed
  • •Requesting information if personal data has been processed
  • •Learning the purpose of personal data processing and whether they are used in accordance with their purpose
  • •Knowing the third parties to whom personal data has been transferred domestically or abroad
  • •Requesting correction if personal data has been processed incompletely or incorrectly
  • •Requesting deletion or destruction of personal data within the conditions stipulated in Article 7 of KVKK
  • •Requesting notification of correction, deletion or destruction operations to third parties to whom personal data has been transferred
  • •Objecting to any negative result arising against you from analysis of processed data exclusively through automated systems
  • •Requesting compensation for damages if you suffer damage due to unlawful processing of personal data

7. How to Exercise Your Rights and Application Method

To exercise your rights specified in Article 11 of KVKK, you can submit your requests with documents verifying your identity in writing with wet signature to "Esentepe Mah. Ecza Sk. Pol Center C Blok No: 4 İç Kapı No: 1 Şişli/İstanbul" address via registered mail or notary.

Additionally, provided that your identity has been previously verified by us, you can also direct your requests to [email protected] email address via secure electronic signature, mobile signature or your email address registered in our system.

Your applications will be concluded free of charge as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request.
